Notices

  • Issue the appropriate eviction notice based on the situation:

Lawsuit

  • Summons and Complaint

  • If the tenant does not comply, file an unlawful detainer lawsuit in court.

  • Properly serve the Summons & Complaint to notify the tenant of legal proceedings.

Hearings

  • Attend scheduled hearings based on the case status:

  • Show Cause Hearing – Tenant can contest the eviction.

  • Contested Hearing – If disputes arise, the court reviews evidence.

Settled by Agreement

  • Negotiate a settlement through a Stipulated Agreement:

  • The tenant may vacate voluntarily or agree to pay & stay under new terms.

  • Attempt resolution before proceeding to court to save time and costs.

Sheriff Eviction

  • Upon court approval, obtain a Writ of Restitution.

  • Coordinate with the sheriff to schedule the physical eviction.

  • File any additional motions if necessary.

  • Order to Show Cause – Requires tenant response.
